Section-A
(Very Short Answer Questions)
(अति लघु उत्तरीय प्रश्न)
Note: Attempt all following five questions with very short answers of not more than 70 words. Each question carries 4 marks. 5×4=20
नोट: सभी पाँच प्रश्नों हल कीजिए। प्रश्नों के उत्तर 70 शब्दों से अधिक न हो। प्रत्येक प्रश्न 4 अंक का है।
1. Explain ‘Mesne Profits’.
‘मध्यवर्ती लाभ’ समझाइये |
2. Explain mis joinder and non joinder of Parties.
पक्षकारों के कुरंयोजन तथा असंयोजन को स्पष्ट कीजिए।
3. Doctrine of constructive Res-judicata?
प्रलक्षित प्राइन्याय का सिद्धान्त समझाइये।
4. Write short note on ‘Reference to High Court. ‘
‘उच्च-न्यायालय को निर्देश’ पर टिप्पणी लिखें।
5. Explain ‘Interlocutory Order.’
‘वाद कालीन आदेश’ को स्पष्ट कीजिये।
Section – B / खण्ड-ब
(Short Answer Questions)
(लघु उत्तरीय प्रश्न)
Note : Attempt any two questions out of the following three questions with short answer not more than 200 words. Each question carries 10 marks. 2×10=20
नोट: निम्नलिखित तीन प्रश्नों में से किन्हीं दो प्रश्नों का संक्षेप में केवल 200 शब्दों में उत्तर दीजिये। प्रत्येक प्रश्न 10 अंकों का है।
6. What is difference between Review and Revision?
पुनरीक्षण तथा पुनर्विलोकन में अन्तर स्पष्ट कीजिये।
7. Explain. properties which cannot be attached.
जो सम्पत्ति कुर्क नही की जा सकती, समझाइये।
8. Explain Res-Subjudice Under Section 10.
धारा 10 के अन्तर्गत विचाराधीन न्याय को व्याख्या कीजिए।
Section-C
(Detailed Answer Questions)
(विस्तृत उत्तरीय प्रश्न)
Note: Attempt any three questions out of the following five questions with detailed answers. Each question carries 20 marks. 3x 20=60
निम्नलिखित में से किन्हीं तीन प्रश्नों के उत्तर दीजिये। प्रत्येक प्रश्न 20 अंकों का है।
9. What do you mean by Plaint? What particulars a plaint should contain?
वाद पत्र से आप क्या समझते हैं? वाद पत्र में कौन-सी विशिष्टियाँ होनी चाहिए।
10. Who is indigent person? Explain the mode for the institution of a suit as an indigent person.
अकिंचन व्यक्ति कौन होता है? अ्किंचन व्यक्ति के रूप में वाद लाने के तरीके पर विवरण दीजिये।
11. Are the foreign judgment conclusive? Are they binding on the parties in India?
क्या विदेशी निर्णय निश्चयात्मक होते हैं? क्या वे भारत के पक्षकारों पर बाध्य हैं?
12. Define an injunction and state its kinds. When be a temporary injunction issued?
व्यादेश को परिभाषा कीजिये और बताइये कि वह कितने प्रकार के होते हैं। अस्थाई व्यादेश कब जारी किया जाना चाहिए?
13. What do you mean by Caveat? Who may lodge caveat? Discuss the rights and duties of the caveator.
कैवियट (निगरानी) से आप क्या समझते हैं? कैवियट कौन डाल सकता है? कैवियटर के अधिकारों एवं कर्तव्यों का वर्ण कीजिए।
